Terms of Service

By accessing or using the Ekayana platform, including the Bio-DID-Sequencer API ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including researchers, institutions, and developers integrating with our APIs.

We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

Ekayana provides decentralized data infrastructure for research and heritage data. The Service includes the following.

• Content addressed storage for research datasets on IPFS.
• W3C conformant decentralized identifiers for research data.
• BioAgents, which extract metadata and build the knowledge graph.
• UCAN capability authorization.
• Bridges to Harvard Dataverse and other research repositories.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

As a user of the Service, you agree to the following.

Account Security

• Keep your wallet keys, session tokens, and delegated credentials confidential.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activity under your account.

Acceptable Use

• Use the Service only for lawful purposes.
• Do not upload malicious code, viruses, or harmful content.
• Do not attempt to gain unauthorized access to our systems.
• Do not interfere with or disrupt the Service or its servers.
• Comply with all applicable laws and regulations.

Data Responsibilities

• Make sure you have the right to upload and share any data.
• Attribute data sources properly and respect intellectual property.
• Follow the ethical guidelines that apply to research data.
• Hold appropriate consent for personal data under GDPR.

Your Content

You retain all rights to the data and content you upload to the Service. By uploading content, you grant us a limited license to store, process, and transmit your content as necessary to provide the Service.

Our Platform

The Ekayana platform, including its software, APIs, documentation, and branding, is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our platform without explicit permission.

Open Source Components

Certain components of our platform are open source and subject to their respective licenses. These licenses are available in our GitHub repositories.

Research Data

We respect the intellectual property rights of researchers. Data uploaded to our platform remains under your control, and we do not claim ownership of your research data.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EKAYANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES.

Data Availability

While we use decentralized infrastructure for redundancy, we cannot guarantee 100% data availability. Users are responsible for maintaining their own backups of critical data.

Third-Party Services

The Service integrates with third-party services such as IPFS and Dataverse. We are not responsible for the availability or performance of those external services.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. On termination the following applies.

• Your right to use the Service ends immediately.
• You may request an export of your data within 30 days.
• We may delete your data after the 30-day period.

Dispute Resolution

Disputes arising from these Terms are resolved in the following order.

• Good faith negotiation between the parties
• Mediation by a mutually agreed mediator
• Binding arbitration under the rules of the International Chamber of Commerce

Governing Law

These Terms shall be governed by the laws of the European Union, specifically GDPR for data protection matters, without regard to conflict of law provisions.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
