Welcome to Ekayana. These Terms of Service govern your use of our Bio-AI DIDs sequencer platform and related services. Please read these terms carefully before using our platform.
1. Acceptance of Terms
By accessing or using the Ekayana Bio-AI DIDs sequencer platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including researchers, institutions, and developers integrating with our APIs.
We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
2. Description of Service
Ekayana provides a decentralized data infrastructure platform for research and heritage data, including:
- Decentralized Storage: IPFS-based content-addressed storage for research datasets
- Decentralized Identifiers (DIDs): W3C-compliant identifiers for research data
- AI Processing: BioAgents for metadata extraction and knowledge graph generation
- Authorization: UCAN-based capability authorization system
- Integration: Connections to Harvard Dataverse and other research repositories
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
3. User Responsibilities
As a user of our Service, you agree to:
Account Security
- Maintain the confidentiality of your API keys and credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities under your account
Acceptable Use
- Use the Service only for lawful purposes
- Not upload malicious code, viruses, or harmful content
- Not attempt to gain unauthorized access to our systems
- Not interfere with or disrupt the Service or servers
- Comply with all applicable laws and regulations
Data Responsibilities
- Ensure you have the right to upload and share any data
- Properly attribute data sources and respect intellectual property
- Comply with ethical guidelines for research data
- Maintain appropriate consent for personal data under GDPR
4. Intellectual Property
Your Content
You retain all rights to the data and content you upload to the Service. By uploading content, you grant us a limited license to store, process, and transmit your content as necessary to provide the Service.
Our Platform
The Ekayana platform, including its software, APIs, documentation, and branding, is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our platform without explicit permission.
Open Source Components
Certain components of our platform are open source and subject to their respective licenses. These licenses are available in our GitHub repositories.
Research Data
We respect the intellectual property rights of researchers. Data uploaded to our platform remains under your control, and we do not claim ownership of your research data.
5. Limitations of Liability
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EKAYANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES.
Data Availability
While we use decentralized infrastructure for redundancy, we cannot guarantee 100% data availability. Users are responsible for maintaining their own backups of critical data.
Third-Party Services
We integrate with third-party services (IPFS, Filecoin, Dataverse). We are not responsible for the availability or performance of these external services.
6. Termination & Disputes
Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:
- Your right to use the Service will cease immediately
- You may request export of your data within 30 days
- We may delete your data after the 30-day period
Dispute Resolution
Any disputes arising from these Terms shall be resolved through:
- Good faith negotiation between the parties
- Mediation by a mutually agreed mediator
- Binding arbitration under the rules of the International Chamber of Commerce
Governing Law
These Terms shall be governed by the laws of the European Union, specifically GDPR for data protection matters, without regard to conflict of law provisions.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
